ABOUT THE LIVING CONSTITUTION

RESUMEN: En este trabajo se analiza el problema de la reforma constitucional y la forma en quela Constitución, a la luz del ejemplo dela Constitución de los EE.UU., a través de mecanismos formales e informales, pero sobre todo a través de una interpretación evolutiva, puede ser un organismo vivo y adaptarse, sin perder su identidad, a la realidad en constante proceso de cambio.

ABSTRACT: The paper discusses the problem of constitutional amendment and how the constitution – in the light of the example of the US Constitution, through formal and informal mechanism, but especially through evolutive interpretation – can be a living organism and can be adapted, without losing its identity, to the constantly changing reality.
