Resumo

THE INFLUENCE OF DIGITALIZATION ON THE CREATION OF LAW

RESUMO: O atual fenômeno da digitalização aplicada ao processo legislativo tributário é objeto de reflexão no presente artigo, especialmente no que se refere à dogmática jurídica alemã. A influência e o impacto do assim denominado direito digital na criação e aplicação das normas de direito tributário, e as consequências práticas no âmbito dos direitos fundamentais dos contribuintes, bem como o uso de algoritmos pela Administração Pública e pelo Parlamento, representam hoje uma importante inovação e um grande desafio no marco do Estado democrático e constitucional de Direito.

ABSTRACT: The current phenomenon of digitalization applied to the tax law process is the object of reflection in this article, especially with regard to German legal dogmatics. The influence and impact of the so-called digital law on the creation and application of tax law, and the practical consequences for the fundamental rights of taxpayers, as well as the use of algorithms by the public administration and parliament, represent today’s principal innovation and a big challenge within the framework of the democratic and constitutional rule of law.
